In Chapters 2, 3 and 7 of his new book, Law as a Leap of Faith, John Gardner provides the elements of an account of legal reasoning. It is on the basis of this account that Gardner defends or supports some of the most important theses of his book, viz. theses pertaining to how law can be made, to the relation between law and morality, and to the legitimacy of judicial law-making. A central element of Gardner’s account is a distinction (...) (suggested originally by Joseph Raz) between two forms of legal reasoning, namely, reasoning about the law and reasoning according to law. In this paper I intend to describe and evaluate Gardner’s account. Among the critical remarks that will appear in the paper is the claim that Gardner’s concept of reasoning according to law is overly inclusive. (shrink)

Ordinary arguments from authority have the following structure: A says p; A is authoritative on such things; so p. Legal actors use such arguments whenever they ground their decisions on the sheer “say-so” of legislators, judges, scholars, expert witnesses, and so on. This paper focuses on arguments appealing to the authority of scholars, “doctrinal” or “dogmatic” legal scholars in particular. Appeal to doctrinal authority is a puzzling feature of legal argumentation. In what sense are doctrinal scholars “authorities”? Is p, as (...) advanced by a scholar, descriptive or prescriptive? Is scholarly authority grounded on expertise or something different? The paper addresses these questions. (shrink)

The paper provides a qualified defence of Bruce Waller’s deductivist schema for a priori analogical arguments in ethics and law. One crucial qualification is that the schema represents analogical arguments as complexes composed of one deductive inference but also of one non-deductive subargument. Another important qualification is that the schema is informed by normative assumptions regarding the conditions that an analogical argument must satisfy in order for it to count as an optimal instance of its kind. Argumentation theorists often disagree about which scheme best represents a given type of argument. Unfortunately, authors sometimes become involved in fruitless pseudo-agreement because they fail to perceive that their supposedly competing schemes are means for achieving different practical or theoretical goals. This paper explains some of the different purposes that an argument scheme may serve, and it indicates how the relevant type of pseudo-disagreement may be avoided.

Anglo-American authors have paid little attention to a subtle distinction that has important jurisprudential implications. It is the distinction between sources of law and the legal norms which can be derived from sources by means of interpretation. The distinction might also be rendered as a threefold one, separating sources of law from legal norms and both of these from that which mediates their relation, namely, methods of legal interpretation. This paper intends to state the “source-norm” distinction clearly and to give (...) examples of jurisprudential insights that are missed, and mistakes that may be made if the distinction is not given its due. “Deductivism” is a broad label for various theories that emphasize the importance of deductive argument in contexts of rational discussion. This paper makes a case for a very specific form of deductivism. The paper highlights the dialectical importance of advancing deductively valid arguments in natural-language reasoning. Sections 2 and 3 explain the various forms that deductivism has taken. Section 4 makes a case for a particular form of deductivism. Section 5 discusses the value of deductive argument in law. There is a remarkable difference between that which Anglo-American legal philosophers more or less unanimously regard as their subject matter and that which prominent Continental writers have emphasized as one of the main topics for jurisprudential discussion. The latter have often directed their attention to something quite specific: not law or the aforementioned law-related phenomena, but the study of law, or legal scholarship. In particular, Continental writers have been interested in legal scholarship as it is characteristically produced by law teachers. (...) Some phrases that may be used to describe this type of scholarship are “doctrinal legal scholarship”, “legal dogmatics”, and “legal science in a narrow a sense”. This paper explains why Anglo-American theorists should keep their minds open to the idea that jurisprudence may take the doctrinal study of law as its subject matter. It also attempts to explain what doctrinal legal scholarship is, and thus engages in precisely the type of jurisprudential inquiry that it is out to promote. (shrink)

Critics of Hartian legal positivism have characterized it as an error theory about judicial discourse —more precisely, about judicial argument in contexts of disagreement about proper interpretive methodology—. The critics have also suggested that Hartian positivism, like error theories in other areas of philosophy, is to be presumed false. The purpose of this paper is to give a precise account of the nature and extent of the error assigned to judges by Hartian positivists. It will be argued that Hartian positivism, (...) even if it can be understood as a form of error theory, should not be likened to, say, error theories in metaethics, where the relevant error is pervasive and mysteriously enduring.Resumen:Los críticos del positivismo jurídico hartiano han caracterizado este enfoque como una teoría del error sobre el discurso judicial —concretamente sobre la argumentación judicial en el contexto de desacuerdos relacionados con una metodología de interpretación apropiada—. Los críticos también han sugerido que el positivismo hartiano, al igual que otras teorías del error en otros campos de la filosofía, ha de ser tomada por falsa. El propósito de este artículo es ofrecer una explicación más cuidadosa de la naturaleza y alcance del error que los positivistas hartianos atribuyen a los jueces. Se argumentará que el positivismo hartiano, aun cuando pudiera ser entendida como una forma de teoría del error, no debería ser relacionada con, por ejemplo, teorías del error en metaética, donde el error relevante es omnicomprensivo y misteriosamente permanente. This paper approaches legal argumentation from a rhetorical perspective. It discusses the nature of the audiences that are targeted by judges in the legal process. Judicial opinions reach diverse groups of people with very different attitudes and expectations: other judges, lawyers, litigants, concerned citizens, etc. One important way in which these groups differ is that some of them are more likely to be persuaded by legalistic, precedent or statute-based arguments, while others expect judges to decide on grounds of justice or (...) equity. So, judges face the challenge of determining whether they should select particular groups for special attention, or whether they have alternative rhetorical means to approach the problem of audience diversity. One strategy that is likely to be recommended by rhetorical scholars is that judges should not try to accommodate the various preferences of their actual readership, but that they should rather invoke an idealized audience or some version of Chaïm Perelman’s universal audience. However, the paper tries to show that the universal audience is of limited value for a discussion about how judges ought to proceed in the face of audience diversity. In particular, the idea of a universal audience does not help judges to make the choice between a legalistic or an equity-based approach to legal decision-making. By showing that this is so, the paper also raises doubts about the common thought that to invoke the universal audience in law is to appeal to natural law. (shrink)

En este breve comentario discuto algunos aspectos de la interpretación de la epistemología de Davidson que sugiere Willian Duica en su reciente libro. Luego de una presentación somera del libro me centro en tres asuntos centrales de la interpretación de Duica. En primer lugar, argumento que su lectura de la crítica de Davidson al dualismo esquema/contenido es muy restrictiva y deja abierta la posibilidad de un realismo directo empirista. En segundo lugar, argumento que en su lectura el propio Duica se (...) compromete inadvertidamente con un empirismo de este tipo y, de este modo, su interpretación entra en tensión con el coherentismo de Davidson. Finalmente, discuto algunos aspectos de la interpretación que hace Duica de la tesis davidsoniana de la triangulación. In this short comment I discuss some aspects of William Duica's interpretation of Davidson's epistemology in a recent book. After a brief review of the book, I focus on three central issues of Duica's interpretation. First, I argue that his reading of Davidson's criticism of the scheme/content dualism is too restrictive and leaves open the possibility of an empiricist direct realism. Second, I argue in his reading Duica inadvertently commits himself to an empiricism of this sort and, as a result, his interpretation is in tension with Davidson's own coherentism. Finally, I discuss some aspects of Duica's interpretation of Davidsonian triangulation. (shrink)

Defenders and opponents of judicial review under charters of rights often share political ideals, and yet disagree deeply on the best means to pro- mote them or on the proper way to balance them in the event of conflict. In his most recent book, Wil Waluchow attempts to provide a theory of judicial review which deals adequately with the popular ideals of stability and adaptability. The cornerstone of his argument is the notion of community morality - that which enables constitutional (...) adjudicators to develop charter law (adaptability) while remaining loyal to democratic and rule of law principles (stability). The aim of this paper is to offer a critique of the notion of community morality; in particular, the aim is to challenge the assumption that the morality of the members of modern plural societies is as uniform as Waluchow’s theory requires it to be.Resumen:Los defensores y oponentes de la figura del judicial review que se lleva a cabo a través de la defensa de las garantías individuales en ocasiones comparten puntos de vista en relación con los ideales políticos, sin embargo, existen profundos desacuerdos en cuanto a la mejor forma de promocionarlos o en cuanto a la manera apropiada de decidir casos concretos en casos de conflicto. En su más reciente libro, Wil Waluchow intenta proporcionar una teoría del judicial review que atienda adecuadamente los ideales comunes de estabilidad y adaptabilidad. El punto medular de su argumento es la noción de la moralidad de la comunidad—aquella que permite a los jueces constitucionales desarrollar las garantías y derechos (adaptabilidad) mientras que se continúa leal a los principios de democracia y Estado de derecho (estabilidad)—. El objetivo de este trabajo es ofrecer una crítica a esta noción de moralidad de la comunidad, concretamente el objetivo es plantear un reto a la cuestión de asumir que la moralidad de los miembros de las sociedades modernas plurales es tan uniforme como lo exige la teoría de Waluchow. This book is about the use of legal scholarship by judges. It discusses the possibility that legal scholarship may function as a genuine source of law in modern municipal legal systems. The book advances a number of claims, some conceptual, some empirical, some normative. The major conceptual claims are found in Chapters 2 and 3, where a general account of the notion of a source of law is provided. Roughly, sources of law are documents or practices (e.g. statutes, judicial decisions, (...) official customs) from which norms can be derived that function as sources of content-independent reasons for judges to decide legal cases one way or another. The relevant notion of content-independence is derived (with qualifications) from H.L.A. Hart's jurisprudence. Indeed, the book's analysis of the concept of a source of law relies at various points on Hartian insights about law and legal reasoning. Chapter 4 argues that legal scholarship - or, more precisely, a particular type of legal scholarship that might be described as standard or doctrinal - can be, and indeed is, used as a source of law in modern legal systems. The conclusion that legal scholarship is used as a source of law (and thus as a source of content-independent reasons for action) may come as a surprise to those who associate judicial recourse to legal scholarship with judicial activism. This association is discussed and criticized in Chapters 5 and 6. It is argued that, in spite of a relatively common opinion to the contrary, legal scholarship can be used to mitigate discretion. In fact, it is precisely because it can be used in this way that judges sometimes refer to scholarship deceptively and suggest that it limits discretion in situations in which it really does not. In a recent article, P. Roger Turner and Justin Capes argue that no one is, or ever was, even partly morally responsible for certain world-indexed truths. Here we present our reasons for thinking that their argument is unsound: It depends on the premise that possible worlds are maximally consistent states of affairs, which is, under plausible assumptions concerning states of affairs, demonstrably false. Our argument to show this is based on Bertrand Russell’s original ‘paradox of propositions’. We should then opt (...) for a different approach to explain world-indexed truths whose upshot is that we may be morally responsible for some of them. The result to the effect that there are no maximally consistent states of affairs is independently interesting though, since this notion motivates an account of the nature of possible worlds in the metaphysics of modality. We also register in this article, independently of our response to Turner and Capes, and in the spirit of Russell’s aforementioned paradox and many other versions thereof, a proof of the claim that there is no set of all true propositions one can render false. Automatized scalable healthcare support solutions allow real-time 24/7 health monitoring of patients, prioritizing medical treatment according to health conditions, reducing medical appointments in clinics and hospitals, and enabling easy exchange of information among healthcare professionals. With recent health safety guidelines due to the COVID-19 pandemic, protecting the elderly has become imperative. However, state-of-the-art health wearable device platforms present limitations in hardware, parameter estimation algorithms, and software architecture. This paper proposes a complete framework for health systems composed of multi-sensor wearable health (...) devices, high-resolution parameter estimation, and real-time monitoring applications. The framework is appropriate for real-time monitoring of elderly patients' health without physical contact with healthcare professionals, maintaining safety standards. The hardware includes sensors for monitoring steps, pulse oximetry, heart rate, and temperature using low-power wireless communication. In terms of parameter estimation, the embedded circuit uses high-resolution signal processing algorithms that result in an improved measure of the HR. The proposed high-resolution signal processing-based approach outperforms state-of-the-art HR estimation measurements using the photoplethysmography sensor. (shrink)

We define the concepts of minimal p-morphic image and basic p-morphism for transitive Kripke frames. These concepts are used to determine effectively the least number of variables necessary to axiomatize a tabular extension of K4, and to describe the covers and co-covers of such a logic in the lattice of the extensions of K4.

David Chalmers argued against the claim that for all p, or even for all entertainable p, it is knowable a priori that p iff actually p. Instead of criticizing Chalmers’s argument, I suggest that it can be generalized, in a sense, and in interesting ways, concerning other principles about contingent a priori truths. In particular, I will argue that the puzzle presented by Chalmers runs parallel to others that do not turn on ‘actually’. Furthermore, stronger arguments can be presented that (...) do not turn on apriority either, though they do entail the conclusion of Chalmers’s argument. All such puzzles involve interactions between rigidifying sentence-forming devices with factive operators. (shrink)

The aim of the study was to evaluate the effectiveness of a media literacy intervention targeting, for the first time, the specific topic of Performance and Appearance Enhancing Substances use in high-school students. Overall, 389 students aged between 13 and 19 years participated to a media literacy intervention while 103 students aged between 14 and 19 year were considered as the control group. In two separate occasions over the course of six consecutive months, students in both groups filled out a (...) set of questionnaires which included measures of social-cognitive beliefs and a self-reported measure of retrospective use of doping and supplements. Compared to students in the control group = 1.96; SD= 0.85; and Mean= 2.09; SD= 0.94), intervention students on average expressed relatively stronger attitudes against doping use over time = 2.2; SD= 0.85; and Mean= 2.05; SD= 0.82). Students in the latter group also showed a statistically significant decrease in self-reported supplement use = 6.7%; Use= 3.8%;p= 0.05, McNemar Test). Interestingly, albeit marginally significant, students in the control group showed a relative increment in the self-reported use of supplements over time = 4.9%; Use= 8.7%;p= 0.22, McNemar Test). Overall, the media literacy intervention investigated in the present study was effective in decreasing adolescent student’s positive attitudes toward doping use and in reducing the use of legal PAES. These findings supported the generalizability and the usefulness of a media literacy approach in the specific field of PAES. (shrink)

Since last year, major initiatives have been undertaken by the chair of theoretical philosophy at the University of Tübingen in order to enhance the reception of analytic metaphysics in the European landscape. Here we review the 2013 summer workshop, intended to be the first of an annual series, on “Existence, Truth and Fundamentality”, the invited speakers being Graham Priest (Melbourne), Stephan Leuenberger (Glasgow), Dan López de Sa (Barcelona), Francesco Berto (Aberdeen), Friederike Moltmann (Paris – Pantheon Sorbonne) and Jason Turner (Leeds). (...) The workshop’s scope is fairly large, focusing on three different aspects of contemporary research in metaphysics. However, the underlying idea of organizers Thomas Sattig and Alessandro Torza consisted in exploring their interconnections and even new areas which possibly share the same problem spectrum. Also, they thought of bringing together both young and senior protagonists of the contemporary debate. In this sense, the main thread followed by the speakers consisted in enquiring the ideas of fundamentality, dependence and grounding with respect to ontology (Berto, López de Sa, Turner) and the truthmaking debate (Priest, Moltmann, Leuenberger), thus pretty much in line with some latest tendencies in metaphysics, such as, prima inter paria, the works of Kit Fine. When we say that something is more fundamental than something else, we move into a non-conventional (for the standards of 20 th century philosophy) metodological framework, hardly focusing on the question about what there is, and rather tackling the issue of how fundamentally there is what there is, or how the existence of something is required as a ground for the existence of other things. Here is how Jonathan Schaffer explains the methodological transition in his influential “On What Grounds What” (2009): -/- Among the many assumptions Quine and Carnap share is that metaphysical questions are existence questions, such as whether numbers exist. They only disagree on the further issue of whether such questions are meaningful (at least as the metaphysician might pose them). But why think that metaphysical questions are existence question of this sort? Return to Aristotle’s Metaphysics. There are virtually no existence question posed. The whole discussion is about substances (fundamental units of being). At one point Aristotle pauses to ask if numbers exist, and his answer is a brief and dismissive yes. [. . . ] For Aristotle, the question about numbers is whether they are transcendent substances or grounded in concreta. The question is not whether numbers exist, but how. (Schaffer, 2009, p. 347) -/- The conference opened with Graham Priest’s intriguing and peculiar review of Buddhist cornerstone “The Fundamental Verses of the Middle Way” (Mūlamadhyakamakārikā) by Nāgārjuna (ca. 150-ca. 250 AD), seen as a unrecognized forerunner of multi-valued semantics and dialetheism. Priest shows that Nagarjuna’s thought indeed has valuable analytic grip (contrary to the traditional mystical dismiss of his works altogether) and is even in accord to some formal schemas rejecting both the laws of excluded middle and non-contradiction. Dan López de Sa was interested in the topic of grounding, raising concerns about how to explain the kind of “reality” exemplified by what is not fundamental, but rather derivative on something else. He proposes a conceptual and non-primitive analysis of grounding as linked to fundamentality and derivation, and argues that the view can be advocated along with the acceptance that at least something is not fundamental. Subsequently, he illustrates an impressive range of applications linked to contemporary debates in meta-ontology, truthmaking and philosophy of time. Stephan Leuenberger discussed a semantics for “total logic”, a variant of first order logic which is claimed to have several applications with respect to the issue of excluding negative existentials from the scope of theories accounting for a given ’totality’ of facts. For example, materialism is the claim that everything there is can be traced back to physical facts or to truth implied by those facts. What about the claim that “There are no angels”? According to Leuenberger, ordinary logic falls prey of modal arguments (if it is possible that there are angels, by modus tollens, that it is not metaphysically necessary that everything there is is physical). So, there is space for the introduction of a new operator, the totality operator, claiming of what enters its scope that “that’s the whole truth”. Consequently, total logic’s semantics tackles David Chalmers’ well-known conceivability-based argument in favour of zombie’s (subjects producing behaviour but experiencing no qualia) possible existence. Friederike Moltmann presented a massive array of natural language-based examples on the role played by case-constructions, such as “it is the case that Caesar crossed the Rubicon”, “the case of the stolen statue”, “the case in which it might rain”, and so forth. She suggests that we should take surface phenomena of our language very seriously with regard to the determination of ontological categories and truth-makers. Cases are provided by many natural languages with their own existence predicates (“to occur” and “to present itself ”), and these do not apply to other kind of entities, such as objects and events. Trying to derive a substantive thesis on their nature, she claims that they are filtered entities, a structure taking into account some features of the corresponding objects and events and preserving their relational pattern. Jason Turner discussed meta-ontological concerns against the claim that ontological debates are defective. Analysed the structure of a metaphysical theory and identified two different forms of defectiveness that can occur in ontological questions, the defection from without and the defection from within, the author provided an original solution in order to avoid such difficulties. He argued thus in favor of a logical constancy, a translation principle thanks to it would be possible reconceive an ontological defection. Lastly, Francesco Berto’s talk closed the workshop with a sagacious discussion of meinongian quantification. He substains that Meinongians and Quineans experience no conceptual equivocation. Even if the former claims that “There are things that do not exist”, something that the latter contrasts with the interpretation of existential quantifiers as all-including, they still rely upon the same concept of “existence” and they understand each other when they are outside the ontology room, so that it cannot be that they lack competence. Subsequently, Berto deals with the objection that Meinongians commit analytic falsehood in separating the meaning of “to be” from that of “exists”. The Quinean has no independent evidence for analytic equivalence aside from her emphatic stress on the “is” in “there is”. Meinongians, however, can retort to linguistic considerations and claim that existence predicates display fairly different functions. -/- As for what regards our internal division of the “philosophical labor”, Fabio Ceravolo reviewed Moltmann and Berto’s talks; whereas Mattia Cozzi took care of Priest’s and Leuenberger’s, and Mattia Sorgon of those given by López de Sa and Turner. Conclusively, we would like to thank Thomas Sattig and Alessandro Torza for all of their organizational efforts and the kind welcome they reserved to us. Prediction Error Minimization theory (PEM) is one of the most promising attempts to model perception in current science of mind, and it has recently been advocated by some prominent philosophers as Andy Clark and Jakob Hohwy. Briefly, PEM maintains that “the brain is an organ that on aver-age and over time continually minimizes the error between the sensory input it predicts on the basis of its model of the world and the actual sensory input” (Hohwy 2014, p. 2). An interesting (...) debate has arisen with regard to which is the more adequate epistemological interpretation of PEM. Indeed, Hohwy maintains that given that PEM supports an inferential view of perception and cognition, PEM has to be considered as conveying an internalist epistemological perspective. Contrary to this view, Clark maintains that it would be incorrect to interpret in such a way the indirectness of the link between the world and our inner model of it, and that PEM may well be combined with an externalist epistemological perspective. The aim of this paper is to assess those two opposite interpretations of PEM. Moreover, it will be suggested that Hohwy’s position may be considerably strengthened by adopting Carlo Cellucci’s view on knowledge (2013). (shrink)

Although philosophers have been concerned with truth since at least the age of Plato, the last thirty years have witnessed a veritable explosion of the philosophical debate on this topic. The touchpaper which lit the fuse for this was undoubtedly the Deflationist Renaissance (half a century after the seminal work of F.P. Ramsey) due, in the Seventies, both to the Quinean disquotational interpretation of the Tarskian truth definitions and to the development of the prosentential theory of truth by D. Grover, (...) J. Kamp and N. Belnap, and, from the second half of the Eighties onwards, to the forceful defences of deflationary conceptions provided by H. Field and P. Horwich. The philosophical struggle on deflationism has been thought-provoking: by arguing on the merits and shortcomings of such a conception, philosophers have come to broaden and deepen the discussion on truth beyond the boundaries of deflationism. The varieties of problems tackled by the essays in this book highlight how the land of Truth is still far from having been totally explored, and how, in this intellectual endeavour, real progresses can be achieved. This article analyses some of the problems that arise when one attempts to relate philosophical naturalism to scientific realism. In particular, it will be highlighted that scientific realism implies a non-revolutionary view of the future of science and that it is not easy to make such a view of the future of science compatible with a naturalist stance.

The idea that an adequate semantics of ordinary language calls for some theory of events has sparked considerable debate among linguists and philosophers. On the one hand, so many linguistic phenomena appear to be explained if (and, according to some authors, only if) we make room for logical forms in which reference to or quantification over events is explicitly featured. Examples include nominalization, adverbial modification, tense and aspect, plurals, and singular causal statements. On the other hand, a number of deep (...) philosophical questions arise as soon as we take events into consideration. Are events entities of a kind? What are their identity and individuation criteria? How does semantic theorizing depend on such metaphysical issues? All around the world in March, due to COVID-19, competitive sport calendars were suddenly canceled, jeopardizing the training programs of athletes. Moreover, in Italy, the government banned all non-essential travel across the entire country from the beginning of March. Consequently, Italian cyclists were banned from leaving their homes and therefore unable to perform their ordinary training activities. The Italian Association of Professional Cyclists early on during that period noticed that several cyclists were experiencing a worrying decrease in their mental well-being (...) and asked the authors to set up an online Sport Psychology Intervention during lockdown to enhance the athletes' mental health. Through a number of unprecedented events and considerations, the aim of the current investigation was to assess the Italian cyclists' mental health during the lockdown and its changes after the SPI. We validated the Italian version of the Sport Mental Health Continuum Short Form —presented in Study 1—and then applied it to a sample of Italian professional cyclists—presented in Study 2—prior to and after the SPI. To achieve these objectives, the reliability and construct validity of the Italian version of the Sport MHC-SF were tested in Study 1. RM-MANOVA tests were run to evaluate the effect of SPI on cyclists in Study 2. A total of 185 Italian athletes were involved in the validation of the MHC in Study 1 and 38 professional cyclists in Study 2. Results from Study 1 suggested a three-factor higher order model of Sport MHC-SF [Model fit: χ2 = 471.252, p < 0.000; CFI = 0.951; RMSEA = 0.049; RMR= 0.048]. MCFA showed that the default model kept invariance among groups of athletes. Results from Study 2 highlighted that professional cyclists who followed the SPI were able to cope better with psychological stressors, showing improved well-being compared to the athletes that did not. No significant differences were found for emotional and social well-being. The present multi-study paper contributes to the theoretical field with a validated measure of Sport MHC-SF translated in the Italian language and culture. It also provides practical implications related to cases of reduced mental health due to injury, illness, or similar situations of home confinement in the future. (shrink)

We propose a semantic analysis of the particles afinal (European Portuguese) and alla fine (Italian) in terms of the notion of truth unpersistence, which combines both epistemic modality and constraints on discourse structure. We argue that the felicitous use of these modal particles requires that the truth of a proposition p* fail to persist through a temporal succession of epistemic states, where p* is incompatible with the proposition modified by afinal/alla fine, and that the interlocutors share knowledge of a previous (...) epistemic attitude toward p*. We analyze two main cases, that of plan-related propositions and that of propositions without plans. We also discuss the connections between truth unpersistence and evidentiality. (shrink)

The considerable prominence of internet addiction (IA) in adolescence is at least partly explained by the limited knowledge thus far available on this complex phenomenon. In discussing IA, it is necessary to be aware that this is a construct for which there is still no clear definition in the literature. Nonetheless, its important clinical implications, as emerging in recent years, justify the lively interest of researchers in this new form of behavioral addiction. Over the years, studies have associated IA with (...) numerous clinical problems. However, fewer studies have investigated what factors might mediate the relationship between IA and the different problems associated with it. Ours is one such study. The Italian version of the SCL-90 and the IAT were administered to a sample of almost 800 adolescents aged between 16 and 22 years. We found the presence of a significant association between IA and two variables: somatization (β = 7.80; p < 0.001) and obsessive-compulsive symptoms (β = 2.18; p < 0.05). In line with our hypothesis, the results showed that somatization predicted the relationship between obsessive-compulsive symptoms and IA (β = −2.75; t = −3.55; p < 0.001), explaining 24.5% of its variance (ΔR2 = 1.2%; F = 12.78; p < 0.01). In addition, simple slopes analyses revealed that, on reaching clinical significance (+1 SD), somatization showed higher moderation effects in the relationship between obsessive-compulsive symptoms and IA (β = 6.13; t = 7.83; p < 0.001). These results appear to be of great interest due to the absence of similar evidence in the literature, and may open the way for further research in the IA field. Although the absence of studies in the literature does not allow us to offer an exhaustive explanation of these results, our study supports current addiction theories which emphasize the important function performed by the enteroceptive system, alongside the more cited reflexive and impulsive systems. a recent paper, Fábio Perin Shecaira proposes a defence of Waller’s deductivist schema for moral analogical argumentation. This defence has several flaws, the most important of them being that many good analogical arguments would be deemed bad or deficient. Additionally, Shecaira misrepresents my alternative account as something in between deductivism and non-deductivism. This paper is both an attempt at solving this misunderstanding and an analysis and criticism of Waller and Shecaira’s forms of deductivism.

This is my reply to five extended critical assessments of my book Law as a Leap of Faith, appearing together in a symposium issue of Law and Philosophy. The critics are Kevin Toh, Luís Duarte d’Almeida and James Edwards, Fábio Perin Shecaira, Cristina Redondo, and Matthew Smith. The topics include H.L.A. Hart’s philosophical legacy, the moral claims of law, the nature of legal reasoning, the doctrine of legal positivism, and the possibility of alienation from law.
